Two pieces

Some readers of this blog might be interested in two pieces I’ve posted recently on SSRN.

The first is an upcoming book chapter on “The Natural Law Challenge to Choice of Law.” In addition to a discussion of the relation of natural law (if it exists) to positive law and sovereign political deliberation, it also includes, maybe unexpectedly, a discussion of inter-religious encounter.

The second is a much older article titled “The Yoke of Heaven, the Question of Sinai, and the Life of Law” on the basis for authority in the jurisprudence of Jewish law.  I’m posting it now partly because it will feed into the work I’m doing this year as a fellow at the Tikvah Center for Law & Jewish Civilization.
